I have a judgment in Texas — what can I do to collect?
A Texas judgment is enforceable for ten years from the date it is signed and is renewable. Common collection tools include abstracts of judgment recorded against real property, writs of execution against non-exempt assets, post-judgment discovery, turnover orders, and garnishment of non-wage accounts. Texas does not permit wage garnishment for ordinary debts.
Can I collect on a judgment from another state in Texas?
Yes. A sister-state judgment can be domesticated in Texas under the Uniform Enforcement of Foreign Judgments Act, after which Texas collection tools become available. Foreign-country judgments follow a separate recognition process under the Uniform Foreign Country Money Judgments Recognition Act.
How long do I have to collect a Texas judgment?
A Texas judgment is enforceable for ten years from entry. It can be renewed by writ of scire facias or by filing a new action on the judgment, extending the enforcement window. Letting a judgment go dormant can complicate or end collection, so prompt action matters.
What assets are exempt from collection in Texas?
Texas has some of the strongest debtor exemptions in the country. Homesteads, certain retirement accounts, life insurance, and significant categories of personal property are generally exempt. Wages from current employment are also largely exempt. We evaluate non-exempt assets specific to each debtor.
